Condition 8107 on the Visa 482: Work Limits and Obligations

The visa 482 is granted with specific conditions printed on the visa. Condition 8107 is the most important one for the worker — it defines what you can and cannot do for the entire period of the visa.

What condition 8107 requires

Condition 8107 requires you to:

  1. Work for the correct sponsor named on the approved nomination
  2. Work in the correct occupation (ANZSCO code) recorded on the nomination
  3. Not work for a third party where your sponsor “on-hires” you, unless this is separately approved

This is a mandatory condition — a breach can lead to visa cancellation.

What “on-hire” means and why it matters

“On-hire” means the company sponsoring you actually places you to work at another company. For example, an IT staffing company sponsors you but places you full-time at a client site.

Condition 8107 limits on-hire: you can only be on-hired if your nomination was approved for that on-hire arrangement. You cannot be on-hired at will without approval.

Many IT staffing companies operate under this model — if you are in a similar situation, confirm clearly whether the nomination includes on-hire.

Common breach situations

Taking extra work for another employer

Taking a side job from another employer — whether part-time, casual or freelance — breaches condition 8107. There is no exception for “small extra work”.

Changing roles within the same company

If the company moves you to a different division or changes your role, the old nomination may no longer be valid. A new position with a different ANZSCO code requires a new nomination before you transfer.

A personal ABN

Registering an ABN to earn contractor income outside your sponsoring company is a breach — even for small one-off freelance work.

Working at a different location

If the nomination specifies a particular work location and you regularly work at a different location (not just occasionally), this can create a problem.

When there is no breach

There is no breach of condition 8107 when:

  • You do the correct work for the correct employer as set out in the nomination
  • The company occasionally requires you to work temporarily at a client site but you remain under the direct supervision of the employer

Consequences of a breach

Breaching condition 8107 can lead to:

  • Cancellation of the visa 482
  • Being placed on a “non-compliance” record that affects future visa applications
  • In serious cases: removal and a bar on re-entry

The Department of Home Affairs may detect a breach through: reports from a former employer, random checks, tax data from the ATO, or complaints from a third party.
